By accessing this web site or posting your advertisement on TheAdNet Classifieds ("Service"), operated by Internet Advertising Technology, Inc. ("TheAdNet"), you ("You") agree to comply with these Terms & Conditions ("Terms") of use.

ACCEPTIBLE CONTENT

You understand that all postings, messages, text, files, images, photos, video, sounds, or other materials ("Content") posted on, transmitted through, or linked from the Service, are the sole responsibility of the person from whom such Content originated. More specifically, you are entirely responsible for each individual item ("Item") of Content that you post, email or otherwise make available via the Service. You understand that TheAdNet does not control, and is not responsible for Content made available through the Service, and that by using the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. Furthermore, the TheAdNet site and Content available through the Service may contain links to other websites, which are completely independent of TheAdNet. TheAdNet makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such site. Your linking to any other websites is at your own risk. You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will TheAdNet be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Service.

You agree that you will NOT post:

Any form of Adult content, or material not suitable for minors and a G-rated audience.
Illegal activity, Hacking/Cracking/Software Pirating/Warez.
Offensive or inappropriate language, hate material, or other undesirable content.
Multiple posting of the same ad, or variations of an ad for the same item.

ACCESS TO THE SERVICE

TheAdNet grants you a limited, revocable, nonexclusive license to access the Service for your own personal use. This license does not include: (a) access to the Service by Posting Agents; or (b) any collection, aggregation, copying, duplication, display or derivative use of the Service nor any use of data mining, robots, spiders, or similar data gathering and extraction tools for any purpose unless expressly permitted by TheAdNet. A limited exception to (b) is provided to general purpose internet search engines and non-commercial public archives that use such tools to gather information for the sole purpose of displaying hyperlinks to the Service, provided they each do so from a stable IP address or range of IP addresses using an easily identifiable agent and comply with our robots.txt file. "General purpose internet search engine" does not include a website or search engine or other service that specializes in classified listings or in any subset of classifieds listings such as jobs, housing, for sale, services, or personals, or which is in the business of providing classified ad listing services.

AD LISTING ACCURACY DISCLAIMER AND REMOVAL

By accessing the Service, you understand that TheAdNet is not responsible for the completeness or accuracy of the information on published pages. In particular, you should be aware that this information may be incomplete, may contain errors or may have become out dated. Additionally, TheAdNet is not liable for any part of the financial or shipping transactions associated with any products or services offered in posted ads, and will not be responsible for mediating any transaction disputes. These are the advertiser and/or buyer's sole responsibilities.

By placing an ad at TheAdNet, you agree to limit any claim for failure to list an ad and waive any claim for consequential, incidental, or other special damages. Please check your ad details before submission. All accepted ads are subject to review. TheAdNet
reserves the right to decline, move or remove a posted ad at any time.

PAID ADVERTISING AND REFUNDS

Advertising in certain sections of the Service, may require a small fee. When placing an ad in a paid section, you will be notified of the posting fee in advance of posting your ad. TheAdNet accepts Visa, MasterCard, and Discover credit cards for all online classified ads only. No cash, check, C.O.D., money order, cashier's check or certified checks are allowed as payment for this "all electronic" service. All payment amounts received by TheAdNet shall be prepaid in U.S. dollars. Pricing and offers are subject to change without notice.

No refunds, changes, exchanges and/or cancellations of or to an ad are possible once the ad has been posted. However, you may edit your ad at any time by accessing it with the password you choose when posting. Please be sure that your ad is accurate and complete before submitting.

IMPORTANT: The charge on your credit card statement will appear as INTERNET ADVERTISING TECH, the parent company of TheAdNet Classifieds. Please remember when you credit card statement arrives that this charge is for your Online Classified Ad on TheAdNet. See additional important information below regarding disputes/chargebacks.

For "paid" sections, TheAdNet charges a NON-REFUNDABLE fee for the service of publishing your classified listing on the Service in the desired section for at least 90 days. In the event that your credit is not approved, you will not be permitted to post the ad. Upon a successful credit card authorization, You agree that you will contact TheAdNet first to resolve any billing problems, before contacting the issuing bank or credit card company. You further understand and agree that in the event of an unsuccessful chargeback/dispute, you will be liable for any damages resulting from the dispute, including but not limited to; the $25 chargeback fee imposed by the bank, and a flat $25 fee for processing your dispute. All erroneous chargebacks and unauthorized card use will be prosecuted to the fullest extent, with prove of order, proof of published ad copy, your name, IP address, other contact information, website URL, and any email addresses or phone numbers in the ad. All original ad copies are saved even for internal purposed if the published ad is edited or deleted.

INDEMNITY

You agree to indemnify and hold TheAdNet, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of Content you submit, post or make available through the Service.

NO WARRANTEE

YOU AGREE THAT USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK. THE SERVICE IS PROVIDED ON AN "AS IS" OR "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, TheAdNet DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THE SERVICE.

LIMITATIONS OF LIABILITY

UNDER NO CIRCUMSTANCES SHALL TheAdNet BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, RESULTING FROM ANY ASPECT OF YOUR USE OF THE SERVICE.

MODIFICATIONS TO THIS AGREEMENT

TheAdNet reserves the right, at it's sole discretion, to change, modify or otherwise alter these Terms at any time. Such modifications shall become effective immediately upon the posting thereof.
